All NabeelaSolutions.com users (account holders or not) must comply with NabeelaSolutions' Terms.
Use of any of NabeelaSolutions' Services constitutes acceptance and agreement of NabeelaSolutions' Terms.
Service Rates:
Subscriber acknowledges that the nature of the service furnished and the initial rates and charges have been communicated to Subscriber. Subscriber is aware that the Company may prospectively change the specified rates and charges from time to time. The promotional offer is contingent upon Company achieving and maintaining its cost of service goals including but not limited to rates charged to company by its suppliers.
Subscriber acknowledges that the service provided is of such a nature that service can be interrupted for many reasons other than the negligence of the company and that damages resulting from any interruption of service are difficult to ascertain. Therefore, subscriber agrees that the company shall not be liable for any damages arising from such causes beyond the direct and exclusive control of the company. Subscriber further acknowledges that the company's liability for its own negligence may not in any event exceed an amount equivalent to charges payable by subscriber for services during the period damages occurred. In no event shall the company be liable for any special or consequential damages, loss or injury.
If we register your domain, the process can take up to 7 days depending on the registrar but if we transfer your domain, the process can take up to 60 days, depending on what registrar your domain is registered with.
We support the uncensored flow of information and ideas over the Internet and do not actively monitor subscriber's activity under normal circumstances. Similarly, we do not exercise editorial control over the content of any web site, e-mail transmission, newsgroups, or other material created or accessible over or through the services, except for certain proprietary Web sites. However, in accordance with our Terms of Service, we may remove any materials that, in our sole discretion, may be illegal, may subject us to liability, or which may violate any existing law or any of NabeelaSolutions' terms. NabeelaSolutions may cooperate with legal authorities and/or third parties in the investigation of any suspected or alleged crime or civil wrong doing. Your violation of this terms may result in the suspension or immediate termination of either your NabeelaSolutions account or other actions as detailed below WITHOUT PRIOR NOTICE.
NabeelaSolutions does not issue refunds or prorate any fees.
You may not use the service in any way that will cause an interruption of services to other users of our network or networks that are reachable by our network.
Neither subscribers sites contents, nor their views are necessarily those of NabeelaSolutions'; however Child Pornography, Harming a Minor, Harassment, Bestiality, Copy Right Infringement or Spamming will NOT be tolerated.
You, as NabeelaSolutions customer, are solely responsible for the content stored on and served by your NabeelaSolutions server.
NabeelaSolutions strongly enforces the one site one owner policy.
NabeelaSolutions reserves the right to terminate, and without notice, any account not abiding by the terms of this agreement. Further more, NabeelaSolutions determines what is unlawful, indecent or objectionable at its sole discretion.
You are responsible for any misuse of your account, even if the inappropriate activity was committed by a friend, family member, guest or employee. Therefore, you must take steps to ensure that others do not gain unauthorized access to your account. In addition, you may not use your account to breach security of another account or attempt to gain unauthorized access to another network or server.
Your password provides access to your account. It is your responsibility to keep your password secure. Sharing your password and account access with unauthorized users is prohibited. You should take care to prevent others from using your account since you will be held responsible for such use. Attempting to obtain another user's account password is strictly prohibited, and may result in termination of service.
You must adopt adequate security measures to prevent or minimize unauthorized use of your account.
You may not attempt to circumvent user authentication or security of any host, network or account. This includes, but is not limited to, accessing data not intended for you, logging into or making use of a server or account you are not expressly authorized to access, or probing the security of other networks. Use or distribution of tools designed for compromising security is prohibited. Examples of these tools include, but are not limited to, password guessing programs, cracking tools, or network probing tools. Exe files, zip files, pdf files, files over 350KBs and all programs are strictly prohibited and may result in account termination without notice. You may not attempt to interfere with service to any user, host or network ("denial of service attacks"). This includes, but is not limited to, "flooding" of networks, deliberate attempts to overload a service, and attempts to "crash" a host.
Users who violate systems or network security may incur criminal or civil liability. NabeelaSolutions will cooperate fully with investigations of violations of systems or network security at other sites, including cooperating with law enforcement authorities in the investigation of suspected criminal violations.
Bandwidth and Disk Usage:
Customer agrees that bandwidth and disk usage shall not exceed the number of megabytes per month for the Services ordered by Customer on the Order Form. NabeelaSolutions will monitor Customer's bandwidth and disk usage. NabeelaSolutions shall have the right to take corrective action if Customer's bandwidth or disk usage exceeds the Agreed Usage. Such corrective action may include the assessment of additional charges, disconnection or discontinuance of any and all Services, or termination of this Agreement, which actions may be taken is in NabeelaSolutions' sole and absolute discretion. If NabeelaSolutions takes any corrective action under this section, Customer shall not be entitled to a refund of any fees paid in advance prior to such action. In the event that a customer exceeds the included allocation, NabeelaSolutions may, at its sole discretion, collect a deposit, in an amount determined by NabeelaSolutions, against customer's credit card on file with NabeelaSolutions. If NabeelaSolutions has no credit card on file for said client there will be an interruption of service till a deposit determined by NabeelaSolutions is collected.
NabeelaSolutions accounts operate on shared resources. Excessive use or abuse of these shared network resources by one customer may have a negative impact on all other customers. Misuse of network resources in a manner which impairs network performance is prohibited by this policy and may result in termination of your account.
You are prohibited from excessive consumption of resources, including CPU time, memory, disk space and session time. You may not use resource-intensive programs which negatively impact other customers or the performances of NabeelaSolutions systems or networks. NabeelaSolutions reserves the right to terminate or limit such activities.
NabeelaSolutions offers high-limit or unlimited amounts of disk space and/or other resources, such as bandwidth transfer, email or FTP accounts. The intention of NabeelaSolutions is to provide ample resources for customer convenience, so that customers need not worry about exceeding limits.
It is acknowledged by users of NabeelaSolutions services that these resource allotments are optimized and dedicated towards serving web documents and self-need email / FTP services and is not to be used as offsite storage area for electronic files, or as a provisioning service for third party email or FTP hosts. All downloadable files or files stored on the server must be available for download via HTML documents stored on the Internet in a publicly or privately accessible area, and must be directly related to the general nature of the website index. Illegal content such as pirated software, music or other media are strictly prohibited and are not allowed on NabeelaSolutions servers.
It is also acknowledged by users of NabeelaSolutions services that these resources are limited by physical restraints of technology as well as by reasonable limits of a shared resource environment. Users must realize that server technology limits the amount of available resources for use, including but not limited to disk space, CPU processing power, memory and access speed. NabeelaSolutions takes measures to utilize the latest and most economically feasible mass server market technology available to provide services. It is furthermore acknowledged by users of NabeelaSolutions services that all provided services are of a shared-server nature, and other users are sharing the provided space. Customer accounts are placed on a server with up to hundreds of other users. NabeelaSolutions, along with many other hosting providers use this business model in order to offer web hosting services en masse at inexpensive and affordable rates.
It is acknowledged that any single account is entitled to utilize the server resources, within reason, up to what is allotted or by what is physically available. If resources become scarce, NabeelaSolutions reserves the right to limit users of the affected machine to a lower limit to preserve the effectiveness of the service for all users. If a particular user is in extreme excess of what the average users of the machine have in use (actually used) of their resource allotments, that customer may be asked to remove content, cut resource usage, or upgrade to a VPS or a dedicated server. This policy only applies to web sites that are considered to be abusive in service, disk space or resource consumption and where it is evident that the fair use of resources among customers has been breached, particularly in regards to disk space, bandwidth or CPU processing power utilization. Additionally, web sites that are found to contain either no html documents, or a large number of unlinked files are subject to warning, suspension or cancellation at the sole discretion of NabeelaSolutions.
If NabeelaSolutions determined a "Fair Use" breach occurs by a user, subscriber may have to remove files from or reduce access to subscriber's account to an extent as determined by NabeelaSolutions, in order to restore full service ability to other subscribers affected by the breach. In any case, the subscriber will be notified of any actions that NabeelaSolutions may have to take.
NabeelaSolutions is under no duty to look at each customer's or user's activities to determine if a violation of the Terms Of Service has occurred, nor do we assume any responsibility through our policies to monitor or police Internet-related activities.
NabeelaSolutions is not responsible for any damages your business may suffer. NabeelaSolutions does not make implied or written warranties for any of our services. NabeelaSolutions denies any warranty or merchantability for a specific purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by NabeelaSolutions.
NabeelaSolutions reserves the right to revise, amend, or modify the above Terms and our other policies and agreements at any time and in any manner. Notice of any revision, amendment, or modification will be posted in accordance with our Terms Of Service.
